Here are the six questions again:

    1. What is the bass line?
    2. What is the harmony?
    3. What does the low brass play?
    4. What do the trumpets play?
    5. What do the horns play?
    6. Who is in the same octave?
Answering these questions for this example:
    1. What is the bass line? - E
    2. What is the harmony? - E Major
    3. What does the low brass play? - E Major chord - root position
    4. What do the trumpets play? - E Major chord - first inversion
    5. What do the horns play? - E Major chord
    6. Who is in the same octave? - cellos
Given the above I play an E in bars 37 & 38, Lionel opts for the less complex Ab/G# already set in the previous bars. Looking at the downbeat of bar 39:
    1. What is the bass line? - Ab
    2. What is the harmony? - Ab Major
    3. What does the low brass play? - Ab Major chord - 6/4 position
    4. What do the trumpets play? - Ab Major chord - first inversion
    5. What do the horns play? - C & Eb
    6. Who is in the same octave? - bassoon 2, basses
Both Lionel and I choose the obvious Ab here, and in both versions no pedal change is necessary. Note the written note is G against this Ab chord (the old seventh of the chord is OK argument again), and in the next bar the music moves back into "step" with the written part.
